ACF seeks an experienced researcher or a research group to conduct studies on mediation service market
Background: The Arbitration Council (AC) of Cambodia is a national institution provided for under the Labour Law and mandated to resolve labour disputes. Supported by the Ministry of Labour and Vocational Training, employers and unions, the AC is internationally and nationally recognised as Cambodia’s premier labour dispute resolution body. The Arbitration Council Foundation (ACF) is an independent and non-political organization that supports the AC through fundraising, training & professional development of arbitrators, and dissemination of information on conciliation, arbitration, the Labour Law, and dispute prevention and resolution services. The roles of the AC and ACF are critical to improving the climate for investment, increasing economic growth and furthering social dialogues and development.
The above-mentioned labour law stipulates that the labour dispute can be referred to settle by any procedure agreed on by all the parties to the dispute, or other procedures under the law (Art. 309). This law also states that the procedure for conciliation and arbitration shall be carried out free of charge (Art.316), but the law is silent about a provision of mediation services. Therefore, fee-based services for mediation of labour and non-labour disputes are subject of investigation and analyses of the laws and practices.
