National Consultant for Child Protection Law Development

  I. Background   The Royal Government of Cambodia has made significant progress to strengthen legislative protection of children from violence, exploitation and abuse. Child protection is stated in different provisions of legislation counting from the constitution to both substantive laws and procedural laws that include the Criminal Code and the Criminal Procedure Code, the Civil Code and the Civil Procedure Code, the Law on Prevention of Domestic Violence and Protection of Victim, the Law on Suppression of Human Trafficking and Sexual Exploitation, the Juvenile Justice Law, the Law on Inter-Country Adoption, etcetera.   Child protection is also seen partially stated in some provisions of administrative law, including regulation such as the Law on Labour, the Law on Education, the Law on Drug Control, the Prakas on Minimum Standard on Alternative Care for Children, and the Prakas on Procedures to Implement the Policy on Alternative Care. However, partial coverage of child protection issues in a variety of legislations poses a challenge in providing a holistic protection and creates gaps in implementation of existing legislations. In this context, the Cambodian National Council for Children (CNCC) developed a plan to draft a sub-decree on child protection. After a further consultation, the Council of Ministers advised that this sub-decree should be upgraded into a law for a greater effect. A comprehensive law would be useful for an enhanced child protection delivery.   II. Purpose of Consultancy   The purpose of this consultancy is to conduct research on child protection related legislation and draft the law on child protection in close collaboration with an international consultant or a team of consultants with an international institution that will be by UNICEF.   III. Key activities   Under the supervision of the Deputy Secretary-General of the Cambodian National Council for Children and advices from the international consultant, the national consultant will undertake the following tasks:   • Conduct research on national child protection related legislation and share research report with CNCC and the international consultant/institution for review. • Support CNCC in organising three consultative workshops (one at the national level, one at the sub-national level, and one with children) prior to drafting the law on child protection and share report on these consultative workshops with CNCC and the international consultant for review. • Work closely with the international consultant/institution to share the new structure of child protection law that is proposed by the international consultant/institution with stakeholders for comments and translate comments in • Khmer into English and share it with the international consultant/institution. • Develop the zero draft law on child protection in collaborationwith the international consultant/institution based on research report, comments from the three pre-consultative workshops, and the new structure proposed • In collaboration with the international consultant/institution support CNCC to organise three consultative workshops to comment on the draft law. • Write and share report in English on the three consultative workshops with the international consultant/institution who will reflect those comments in the draft law.   V. Time frame   The consultancy is expected to be nine months and will start on7th November 2019. The consultant will be based at CNCC (more detail please read in TOR attachment).   VI. Qualifications and Experience Required   • Master’s degree in law • Minimum three years of experience in child rights • Experience in working with UN agencies and Government counterparts • Familiarity with national child protection standards, equity, gender and human rights • Strong analytical skills • Must be lawyer and member of Council of Juris is preferable • Excellent management, interpersonal, planning and coordination skills • Excellent proficiency in English communications and writing skills • Good experience to consult with relevant stakeholders and children • Women and people with disabilities are encouraged to apply.
